The USA is structured differently to the UK in that it has a Federal system. This
means that individuals, and the different professions, are subject to both Federal
and State law.

Generally speaking, the daily running of a pharmacy in the US is governed by the
relevant State laws, but the pharmacist also has to comply with any Federal laws
that may apply. The main thing to remember when deciding which law to comply
with, state or federal, is to go with the most stringent one. As with most things in life
– if you aim to exceed expectations, you won’t go too far wrong.

The bodies that have the greatest influence at the Federal level are the famous FDA
(Food & Drug Administration), the DEA (Drug Enforcement Agency) and the CMS
(Centres for Medicare and Medicaid Services).

The DEA covers controlled drugs, while the CMS has responsibility for public health
care cover. This is important to you as a pharmacist because there is an approved
list of drugs from which prescriptions for public health patients must be taken.

Apart from the bodies above, most of the other regulations come from the relevant
State authorities. This applies particularly in the registration (licensure) of
pharmacists. The NABP (National Association of Boards of Pharmacy) is the body
which co-ordinates the state boards and provides an equivalency evaluation service
known as the FBGEC.

The state boards of pharmacy are there to protect the consumer, not the
pharmacist. The various pharmacy associations are there to protect the pharmacist
and to promote the profession. The 3 biggest and most well known pharmacy
associations in the USA are the APhA (American Pharmacists Association), the
ASHP (American Society of Health-System Pharmacists), and the NCPA (National
Community Pharmacists Association).

The APhA has around 53,000 members and aims to “…provide, education and
advocacy to help all pharmacists improve medication use and advance patient care”.


The NCPA is a Community or retail pharmacy body, which claims 25,000 members.
It represents community or retail pharmacists and pharmacy owners.

ASHP represents mostly hospital pharmacists, and also those in care homes etc. It
has about 30,000 members.
